of the GoGym mobile application

1. General Provisions

1.1 This Privacy Policy (hereinafter referred to as the “Policy”) defines the procedure for processing and protecting the personal data of Users of the GoGym mobile application (hereinafter referred to as the “Application”), owned by «TITAN» Individual Entrepreneur, email: devs@gogym.kz.

1.2 The purpose of the Policy is to ensure the protection of the rights and freedoms of Users when processing their personal data in accordance with the Law “On Personal Data and Their Protection”.

1.3 By installing and using the Application, the User confirms his/her agreement with the terms of this Policy.

2. What data do we collect

2.1 When registering and using the Application, we may collect the following categories of data:

2.1.1 – Surname, name, patronymic;

2.1.2 – Date of birth;

2.1.3 – Phone number

2.1.4 – Email address;

2.1.5 – Profile photo;

2.1.6 – Payment data (via integrated payment systems);

2.1.7 –  Geolocation (optional to search for nearby objects);

2.1.8 – Data on activity within the Application (booking, payment, reviews);

2.1.9 – Device information (IP address, model, OS, application version).

3. Purposes of data collection

3.1 We process personal data for the following purposes:

3.1.1 – User registration and identification;

3.1.2 – Organization of interaction between Clients, Coaches and Sports facilities;

3.1.3 – Ensuring the operation of payment functions;

3.1.4 – Accrual of bonuses and maintenance of transaction history;

3.1.5 – Users support and maintenance;

3.1.6 – Service quality improvement; – Conducting marketing newsletters and notifications (with the User’s consent);

3.1.7 – Protection against fraud and abuse.

4.  Legal basis for processing

4.1 Grounds for processing personal data:

4.1.1 – The User’s consent expressed upon registration in the Application;

4.1.2 – The need to fulfill the contract (provision of services through the Application);

4.1.3 – Compliance with legal requirements;

4.1.4 – Legitimate interests of the Administration in the development and protection of the service.

5. Data storage and protection

5.1 Personal data is stored on secure servers that comply with information security requirements.

5.2 We use technical and organizational measures to protect data from unauthorized access, loss, modification or dissemination.

5.3 Data retention period — the entire period of use of the Application and up to 3 years after Account deletion (unless otherwise required by law).

6. Transfer of data to third parties

6.1 We may share personal data with the following categories of third parties:

6.1.1 – To Partners — Coaches and Sports Facilities, to make reservations and provide services;

6.1.2 To payment systems for processing payments;

6.1.3 – To authorized bodies upon request and on the basis of law;

6.1.4 – To contractors for support and administration of the Application (under confidentiality agreements).

6.2 We do not sell or transfer personal data to third parties without legal grounds.

7. User Rights/The User has the right to:

7.1 Receive information about your personal data and the procedure for their processing;

7.2 Require correction, blocking or deletion of data if it is outdated, inaccurate or processed illegally;

7.3 Revoke consent to data processing (with possible restrictions on the use of the Application);

8. Use of cookies

8.1 For the convenience of the Application, we may use cookies and similar technologies to analyze the use of the service.

8.2 The user can disable cookies in the device settings, which may limit the operation of some functions.

9. Newsletters and notifications 

9.1 Upon registration, the User agrees to receive notifications about important changes, promotions, bonuses and news of the service.

9.2 You can opt out of advertising messages through your profile settings or via a link in emails.

10. Policy Updates

10.1 We may change the Policy by posting a new version of it in the Application.

10.2 Users are notified of important changes by mailing and through the Application interface.

10.3 The current version of the Policy is always available in the Application.
